§ 1 Scope

(1) These General Terms and Conditions (hereinafter: GTC) apply to all contracts concluded via our online shop between us, Giusy Lamattina , and you as our customer. The GTC apply regardless of whether you are a consumer, entrepreneur, or merchant.

(2) All agreements made between you and us in connection with the purchase contract shall arise in particular from these terms and conditions of sale, our written order confirmation, our declaration of acceptance and any supplementary individual agreements.

(3) The version of the General Terms and Conditions valid at the time of conclusion of the contract shall apply.

(4) Any differing or conflicting terms and conditions of the customer shall not be recognized unless we expressly agree to their validity.


§ 2 Conclusion of Contract

(1) The presentation and advertising of items in our online shop does not constitute a binding offer to conclude a purchase agreement.

(2) By submitting an order via the online shop by clicking the "Place order" button, you are making a binding offer to conclude a purchase agreement. You are bound to this order for a period of two (2) weeks, unless you exercise your statutory right of withdrawal.

(3) Receipt of your order will be confirmed by an automated email. This confirmation of receipt does not yet constitute acceptance of your offer. A contract is only concluded when we accept the order by means of an explicit declaration of acceptance or by dispatching the goods.

(4) We can only process orders from customers residing or having their business abroad if they meet a minimum order value. You can find the minimum order value in the pricing information in our online shop.

(5) If delivery of the goods you ordered is not possible, for example because the goods are not in stock, no contract will be concluded. Any payments already made will be refunded immediately.


§ 3 Delivery conditions and reservation of advance payment

(1) We are entitled to make partial deliveries, provided this is reasonable for you.

(2) The delivery period is approximately five (5) working days, unless otherwise agreed. It begins – subject to paragraph 3 – upon conclusion of the contract.

(3) For orders from abroad or in cases of a risk of non-payment, we reserve the right to deliver only after receipt of payment (advance payment requirement). In this case, the delivery period begins upon receipt of payment.

(4) Events of force majeure that significantly impede or render delivery impossible entitle us to postpone delivery for the duration of the impediment. We will inform you of such circumstances without undue delay.

(5) If a package is returned to us due to your absence, refusal to accept delivery, or for other reasons such as failure to collect it from the branch, we will charge you separately for the shipping costs of resending it. If the package contains fresh food items such as salami, cheese, fresh truffles, etc., this amount will not be refunded.

(6) In the event of cancellation after dispatch, the original shipping costs will be deducted from the refund amount.

(7) Even in the case of free delivery – e.g. due to a promotion or a reached purchase value – we reserve the right to subsequently charge the actual shipping costs incurred or deduct them from the refund amount in the event of redelivery or cancellation after shipment.


§ 4 Prices and shipping costs

(1) All prices quoted in the online shop are gross prices including statutory VAT . Shipping costs are added separately.

(2) The shipping costs will be displayed in the order summary before the order is submitted.

(3) If partial deliveries are made at your request, we will calculate the shipping costs for each partial delivery separately.

(4) In the event of a valid cancellation, you may, under the statutory conditions, demand reimbursement of the shipping costs.


§ 5 Payment terms, set-off and right of retention

(1) The purchase price is payable no later than two (2) weeks after receipt of our invoice.

(2) The payment options specified in the online shop apply.

(3) Set-off is only permitted with undisputed or legally established claims. The same applies to the exercise of a right of retention, unless it is based on the same contractual relationship.


§ 6 Retention of Title

(1) The delivered goods remain our property until full payment has been received.

(2) In ongoing business relationships, we retain title to the goods until all claims arising from the business relationship have been fully settled.


§ 7 Warranty

(1) The statutory provisions on claims for defects apply (§§ 434 ff. BGB).

(2) Any additional guarantees, in particular manufacturer's guarantees, remain unaffected by the statutory warranty rights.


§ 8 Liability

(1) We are liable without limitation for damages caused by intent and gross negligence.

(2) In cases of simple negligence, we shall only be liable for breaches of essential contractual obligations (cardinal obligations) and only for typical, foreseeable damages.

(3) Liability for damages to life, body or health remains unaffected. Liability under the Product Liability Act also remains unaffected.


§ 9 Copyrights

All content (texts, images, media) in our online shop is protected by copyright. Use is only permitted with our express written consent .


§ 10 Applicable Law and Jurisdiction

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

(2) If you are a merchant, the place of jurisdiction is our place of business. This does not apply if another exclusive place of jurisdiction is prescribed by law.


§ 11 Return and inspection of food products

(1) In the event of a return of food products, we reserve the right to inspect the goods before issuing a refund. Returns are only possible if the goods are in perfect, unopened, and original packaging .

(2) Foodstuffs which are no longer suitable for consumption after return (e.g. due to improper storage, opened packaging, expiry of the best before date) are excluded from refund .

(3) The return of fresh food items such as salami, cheese, fresh truffles, etc. is generally excluded.
